1. Definitions
-     “Customer” means a contributor to the National Housing Fund (NHF) Scheme which is being administered by the Federal Mortgage Bank of Nigeria.
-     “Terms of Use” means the terms of use of the Website, as set out in this document and as amended from time to time
-     “Website” means the FMBN website, located at https://www.fmbn.gov.ng and subdomain located at https://ibank.fmbn.gov.ng
-     “you” or “your” means you, your employer or any other person or entity that you have legal authority to bind and on behalf of which you may be accepting these Terms of Use
-     “we”, “us” or “our” means Federal Mortgage Bank of Nigeria.
-     “The Bank” means Federal Mortgage Bank of Nigeria.
-     “Service” means the Federal Mortgage Bank of Nigeria's website, internet banking, mobile internet banking, USSD and loan application services.
-     “Access code, Passcode, Username and Password” means the enabling code with which you access the system and which is known to you only. “Account” means NHF contribution account.
-     “PIN” means your personal identification number.
-     “Mailing Address” means the customer’s mailing address in the Bank’s records.
-     “Instruction” means the customer’s request to the bank for the services.
1.1 Introduction
-     The Website and the services referred to on the Website are provided by us. These Terms of Use govern your use of our Website.
-     By using our Website, you indicate that you are aware of, understand and accept these Terms of Use in full. These Terms of Use form a binding agreement between you and us. If you disagree with these Terms of Use or any part thereof, you should immediately cease access of our Website.
1.2 Licence to use website
-     We will make our Website available to you on the terms and conditions set out in these Terms of Use.
-     Unless otherwise stated, we or our licensors own the intellectual property rights in the Website and material on the Website. All these intellectual property rights are reserved.
-     You may view, download and print pages from the Website for your own personal use, subject to the restrictions set out below and elsewhere in these Terms of Use.
-     You may not, without our prior written consent:
-     re-publish, post or otherwise transmit material from this Website (including re-publication on another website), unless you expressly cite this Website as the source of such material;

2. The service allows the Customer to give the bank instructions by use of:
-     Telephone, PIN, Password, Access code and Username for the following:
-     Obtain information about any of our services.
-     Register and obtain a new NHF number.
-     Update records.
-     Apply for FMBN loan products.
-     Send enquiries about our services.
-     Make monthly contributions to the NHF scheme.
Under no circumstances shall the customer allow anybody access to his/her account through the service.
3. The Passcode/Access Code/Password
-     The Customer understands that his/her Passcode, Access Code/ Password is used to give instructions to the bank and accordingly undertakes:
-     That under no circumstances shall the Passcode, Access Code/Password be disclosed to anybody.
-     Not to write the Passcode, Access Code/Password in an open place in order to avoid third party coming across same.
-     The bank is exempted from any form of liability whatsoever for complying with any or all instruction(s) given by means of the customer’s Passcode, Access code if by any means the Passcode, Access code becomes known to a third party.
-     Once the bank is instructed by means of the customer’s Passcode, Access code, and PIN the bank is entitled to assume that those are the instructions given by the customer and to rely on the same.
-     The customer instructs and authorizes the bank to comply with any instructions given to the bank through the use of the service.
-     Where a customer notifies the bank of his intention to change his Passcode, Access code arising from loss of memory of same, or that it has come to the notice of a third party, the bank shall, with the consent of the customer, delete same and thereafter allow the customer to enter a new Passcode, Access code PROVIDED THAT the bank shall not be responsible for any loss that occurs between the period of such loss of memory of the Passcode, Access code or knowledge of a third party and the time the report is lodged with the bank.
-     Once a customer’s Passcode/Access code is given, it shall be sufficient confirmation of the authenticity of the instruction given.
-     The customer shall be responsible for any instruction given by means of the customer’s Passcode/Access code.
Accordingly, the bank shall not be responsible for any fraudulent, duplicate or erroneous instructions given by means of the customer’s Passcode/Access code.
4. Customer’s Responsibility
-     The customer undertakes to be absolutely responsible for safeguarding his username, access code, passcode, PIN, and password, and under no circumstance shall the customer disclose any or all of these to any person.
-     That under no circumstances shall the Passcode, Access Code/Password be disclosed to anybody.
-     Not to write the Passcode, Access Code/Password in an open place in order to avoid third party coming across same.
-     The customer undertakes to ensure the secrecy of his access code, passcode,PIN and password by not reproducing same in any manner whatsoever either in writing or otherwise capable of making it known to persons other than the customer.
-     The bank is expressly exempted from any liability arising from unauthorized access to the customer’s account and/or data as contained in the bank’s records via the service, which arises as a result of inability and/or otherwise of the customer to safeguard his PIN Passcode/Access code and/or password and/or failure to log out of the system completely by allowing on-screen display of his account information.
-     The bank is further relieved of any liability as regards breach of duty of secrecy arising out of customer’s inability to scrupulously observe and implement the provisions of clauses 3(i) & (iii) above, and/or instances of breach of such duty by hackers and other unauthorized access to the customer’s account via the service.
-     The Customer access code and password must be changed immediately it becomes known to anyone else and therefore the customer is under a duty to notify the bank whenever his/her access code and/or password has become known to another person.
-     Where a customer notifies the bank of his intention to change his access code and/or passcode arising from either his loss of memory of same or that it has come to notice of a third party, the bank shall with the consent of the customer, delete same and thereafter allow the customer to enter a new passcode, access code, and password. Provided that the bank shall not be responsible for any loss(es) that occurs between the period of such memory of the access code passcode and/or password or knowledge of a third party and the time the report is lodged with the bank.
-     The Customer shall be responsible for any fraud, loss and/or liability to the bank or third party arising from usage of the customer’s access code, passcode, PIN and/or password being used by a third party
-     The Customer shall be responsible for any fraud, loss and/or liability to the bank or third party arising from usage of the customer’s access code, passcode, PIN and/or password being used by a third party and other unauthorized access. Accordingly, the bank shall not be responsible for any fraud that arises from the usage of the customer’s access code, passcode, PIN and/or password.
5. Damages
Under no circumstances will the bank be liable for any damages, including without limitation direct or indirect, special, incidental or consequential damages, losses or expenses arising in connection with this service or use thereof or inability to use by any party, or in connection with any failure of performance, error, omission, interruption, defect, delay in operation, transmission, computer virus or line or system failure, even if the bank or its representatives thereof are advised of the possibility of such damages, losses or hyperlink to other internet resources are at the Customer risk.
6. Copyrights
Copyright in the pages and in the screens displaying the pages, and in the information and material therein and arrangement is owned by the bank.
7. Electronic Virus or Viruses
The bank shall not be responsible for any electronic virus or viruses that the customer may encounter in course of making use of this service.
8. Limitations of Liability
-   We will not be liable to you in respect of any loss or corruption of any data, database or software, nor for the deletion, corruption or failure to store any messages or other content maintained on or transmitted by way of the Website.
-   In posting a Comment or submitting an Article for publication on the Website, you agree to the publication of comments, reviews and/or feedback on the Comment or Article, by others, on our Website. You acknowledge that such comments, reviews and/or feedback may be critical or defamatory or otherwise unlawful; and you agree that you will not hold us liable in respect of any such comments, reviews and/or feedback, irrespective of whether we are aware or ought to have been aware of such comments, reviews and/or feedback.
-   Our aggregate liability to you under the Terms of Use will not exceed the total amount actually paid by you to us under the Terms of Use.
-   We will not be liable to you in respect of any lossof profits, special, indirect or consequential loss or damage for any reason whatsoever.

9. Indemnity
You hereby indemnify us and undertake to keep us indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by us to a third party in settlement of a claim or dispute on the advice of our legal advisers) incurred or suffered by us arising out of your use of the Website, including, without limitation:
-   a breach of these Terms of Use by you or anyone using your computer (or account, where applicable); and
-   claims brought by any third party relating to defamation, negligent misstatement, injurious falsehood, rights of publicity and/or privacy, copyright infringement, trade mark infringement, other intellectual property infringement, passing off, misleading or deceptive conduct.
10. Service Changes and discontinuation
The bank reserve the right to change or discontinue, temporarily or permanently, the service(s) at any time without notice. In order to maintain the security and integrity of the service(s) the bank may also suspend customer’s access to the service(s) at any time without notice. Customer agrees that the bank will not be liable to the customer or any third party for any modification or discontinuation of the service(s).

Our website includes or may include hyperlinks to other websites owned and operated by third parties. These links are not recommendations. We have no control over the contents of third party websites, and we accept no responsibility for them or for any loss or damage that may arise from your use of them.
12. Law and jurisdiction
These Terms of Use will be governed by and construed in accordance with the laws of The Federal Republic of Nigeria, and any disputes between you and us relating to these Terms of Use will be subject to the jurisdiction of the Federal High Court of Nigeria.
